BOOKINSTEAD

WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT

Platform: Bookinstead

1. Platform Role Disclosure

Bookinstead is an online marketplace that connects customers with independent third-party tour, activity, and rental operators. Bookinstead does not own, operate, control, manage, or provide the tours, rentals, transportation, equipment, food, beverages, or other services offered by operators.

All services are provided directly by the independent operator listed above.

2. Voluntary Participation

I acknowledge that my participation in the booked activity is voluntary.
I confirm that I am physically and mentally capable of participating and do not have any condition that could pose a risk to myself or others.

3. Assumption of Risk

I understand that participation in tours, activities, and rentals may involve risks, including but not limited to:

• Personal injury or death
  • Property damage or loss
  • Equipment malfunction
  • Weather-related hazards
  • Transportation incidents
  • Slips, falls, drowning, collisions, wildlife encounters, or terrain hazards

I voluntarily assume all risks, known and unknown, associated with participation.

4. Operator Responsibility

I understand that the operator is solely responsible for:

• Safety procedures
  • Equipment condition and maintenance
  • Staff conduct and training
  • Compliance with local laws and licensing
  • Insurance coverage

Bookinstead is not responsible for operator actions, omissions, negligence, or service quality.

5. Release of Liability

To the fullest extent permitted by law, I release and hold harmless:

• Bookinstead
  • Its owners, employees, contractors, affiliates, and partners

from any claims, damages, losses, injuries, or expenses arising from:

• Participation in the activity
  • Operator actions or negligence
  • Equipment use
  • Travel to or from the activity

6. Indemnification

I agree to indemnify and defend Bookinstead against any claims, damages, or costs arising from:

• My actions or negligence
  • Violation of operator rules or local laws
  • Damage to equipment or property

7. Medical Treatment and Expenses

I accept full responsibility for any medical expenses incurred.
I authorize emergency medical treatment if necessary and release Bookinstead from liability related to such treatment.

8. Alcohol and Substance Use

If alcohol is permitted during the activity:

• I confirm I meet the legal drinking age
  • I accept all risks related to alcohol consumption
  • I understand operators may remove participants for unsafe behavior without refund

9. Media and Promotional Release

Unless I opt out in writing, I grant Bookinstead and the operator permission to use photos or videos taken during the activity for promotional purposes.

10. Minors

If signing on behalf of a minor, I confirm that I am the parent or legal guardian and consent to their participation in and all terms of this agreement.

All liability for the activity, equipment, and safety rests solely with the independent operator providing the service, not with Bookinstead.
